O'Brien provides a critical assessment of Ernest Mandel's 1975 monograph Late Capitalism. In so doing, he offers a historical narrative that puts into question Mandel's framing of 'waves' of capitalist development as a process of capital accumulation that was dependent upon uneven development in the Third World. O'Brien starts by problematising Mandel's argument that an initial concentration of money, capital and bullion in the hands of Europeans explains combined and uneven development. He goes on to demonstrate that Mandel's (...) notion of imperialism as a necessary conduit for the flow of surplus capital from industrialising Europe does not stand up to the historical evidence. In fact, O'Brien maintains an alternative thesis, namely that these marginalised regions were insuffciently penetrated by European capital. (shrink)

Judicial independence is generally understood as requiring that judges must be insulated from political life. The central claim of this work is that far from standing apart from the political realm, judicial independence is a product of it. It is defined and protected through interactions between judges and politicians. In short, judicial independence is a political achievement. This is the main conclusion of a three-year research project on the major changes introduced by the Constitutional Reform Act 2005, and the consequences (...) for judicial independence and accountability. The authors interviewed over 150 judges, politicians, civil servants and practitioners to understand the day-to-day processes of negotiation and interaction between politicians and judges. They conclude that the greatest threat to judicial independence in future may lie not from politicians actively seeking to undermine the courts, but rather from their increasing disengagement from the justice system and the judiciary. Information is the fourth core element of public health legal preparedness and of legal preparedness for public health emergencies specifically. Clearly, the creation, transmittal, and application of information are vital to all public health endeavors. The critical significance of information grows exponentially as the complexity and scale of public threats increase.Only a small body of organized information on public health law existed before the 21st century: a series of landmark books published beginning in 1926 by Tobey, Grad, and Wing ; (...) model public health laws published as early as 1907; systematic reviews of original research studies published in the 1990s; and a small but growing number of articles published in public health journals and law reviews.With the new century came new public health law programs and activities at the Centers for Disease Control and Prevention, in public health professional associations, and in numerous non-profit and academic organizations. The present article is a sympathetic critique of the most prominent contemporary articulations of family abolitionism. It examines whether queer communist family abolitionism is successful in linking an account of reasons for abolition, with an account of the means of abolition, and finally with an account of the ends of abolition in the form of speculation on a possible world without families. Recent work by M.E. O’Brien has developed these connections in ways that have never been done so thoroughly before; (...) but the rejection of states as an institutional form of political power leaves it unclear what forms of equality we could expect in such a world, and why coercive power would be unnecessary there. Family abolition is a utopian political agenda; but that utopianism needs to be constrained by a realist concern with issues of power, resources, and human capacities. This will require confronting trade-offs and imperfections within possible worlds without families. The recognition that there are many paths to a world without families, and many possible such worlds, is the first step towards aligning reasons, means, and ends and confronting the social and political trade-offs that this entails. For most philosophers in the analytic tradition, the problem is essentially this: how two apparently conflicting kinds of properties can be reconciled and united as properties of the same entity. What is special about the first person has to be reconciled with what is ordinary about it. The range of responses reduces to four basic options. The orthodox view is optimistic: there really is a way of reconciling these (...) apparently contradictory properties as contained within the same thing. One kind of successful communication involves the transmission of knowledge from speaker to hearer. Such testimonial knowledge transmission is usually seen as conforming to three widely held epistemological approaches: reliabilism, impartialism and evidentialism. First, a speaker must be a reliable testifier in order that she transmits knowledge, and reliability is cashed out in terms of her likelihood of speaking the truth. Second, if a certain speaker's testimony has sufficient epistemic weight to be believed by hearer1, then it should also be (...) believed by hearer2. Third, the normative constraint here is evidentially grounded: whether or not a hearer should believe a speaker depends on the evidence the hearer has that the speaker is telling the truth. I argue that there are cases of testimonial knowledge transmission that are incompatible with these three claims. This is when one accepts the testimony of an intimate friend. (shrink)

The 2015 Paris Agreement set a global warming limit of 2°C above preindustrial levels. Corporations play an important role in achieving this objective, and methods have recently been developed to map global climate targets to specific industries, and individual corporations within those industries. In this article, we assess whether Sustainability ratings capture corporate performance in meeting the 2°C target. We analyze nine rating schemes used by investors and three commonly used in academic studies. Most rating schemes do consider corporate greenhouse (...) gas emissions in their analysis, whereas only a minority scale emissions by factors that have the potential to allow benchmarking against science-based targets. None take the final step of mapping climate indicators against the 2°C target. Furthermore, we find a lack of consistency in the climate change ratings of the databases used in academic studies. These results are concerning in the context of being able to meet global climate change goals. (shrink)

O'Brien, Roderick Among the treasures at the Congregational Archives of the Sisters of St Joseph of the Sacred Heart in North Sydney is a booklet, a hymnal: a collection of hymns and sacred songs attributed to Fr Julian Tenison Woods.1 The purpose of this short article is to introduce one of those hymns, and provide some information about poetry and songs in Woods's life and mission. I am grateful to the archivist for making this booklet available. Introducing this particular (...) hymn, 'Longing to Go', also gives us some insight into Woods's spirituality regarding death and regarding mission. (shrink)

It is suggested that George Cotkin's essay is unpersuasive in its two central claims. Firstly, the evidence is not persuasive that there has been a discernible "moral turn" among historians in the last two decades; rather, it is argued that an engagement with morality has been fairly constant in historical scholarship since its ancient origins. Secondly, it is felt that Cotkin is evasive on whether he wishes historians merely to have opinions about the moralities of others in the past or (...) to be moral agents themselves; the first position is thought to be tenable, the latter probably not. While much has been written about the functional profile of intentions, and about their normative or rational status, comparatively little has been said about the subjective authority of intention. What is it about intending that explains the ‘hold’ that an intention has on an agent—a hold that is palpable from her first-person perspective? I argue that several prima facie appealing explanations are not promising. Instead, I maintain that the subjective authority of intention can be explained in terms of the inner (...) structure of intention. In adopting an intention the agent comes to see herself as criticizable depending on whether she executes the intention. This allows us to explain in first-personal terms why the agent becomes disposed to act and deliberate in ways that are characteristic of intention. As intention-formation involves profound changes to reflexive evaluative attitudes, this is the ‘Self-Evaluation’ view of the subjective authority of intention. (shrink)

O'Brien, Roderick When we held the Woods Centenary Seminar in 1989, the local Naracoorte Herald gave us excellent publicity. I recall sitting with the editor, Richard Peake, as he was briefed by the great Sr Margaret Press, assisted by Fr Kevin Horsell, the parish priest of Bordertown who brought his scientific background, and by me. The editor asked the question: 'If Mary MacKillop is to be canonised, why not Woods?'.

Stich begins his paper "What is a Theory of Mental Representation?" by noting that while there is a dizzying range of theories of mental representation in today's philosophical market place, there is very little self-conscious reflection about what a theory of mental representation is supposed to do. This is quite remarkable, he thinks, because if we bother to engage in such reflection, some very surprising conclusions begin to emerge. The most surprising conclusion of all, according to Stich, is that most (...) of the philosophers in this field are undertaking work that is quite futile: " It is my contention that most of the players in this very crowded field have _no_ coherent project that could possibly be pursued successfully with the methods they are using. " Stich readily admits that this is a startling conclusion; so startling, he thinks, that some may even take it as an indication that he has simply "failed to figure out what those who are searching for a theory of mental representation are up to". But it is a conclusion that he is willing to stand by, and he sets about it defending it in the body of his paper. (shrink)

What is special about successful action explanation is that it reveals what the agent saw in her action. Most contemporary philosophers assume that this amounts to explanation in terms of the reason for which the agent acted. They also assume that such explanations conform to a realist picture of explanation. What is disputed is whether the reason is a psychological state or a normative state of affairs . I argue that neither psychological states nor their contents suffice to make actions (...) intelligible in the right way , while Anti-Psychologism can’t explain acting on bad reasons . The alternative that I propose, Proceduralism, has it that explaining an action requires simulating the agent’s practical deliberation. On this view, explanation is not grounded in reasons, and thereby avoids the problems with “bad” reasons that Anti-Psychologism faces. Instead, in simulating to the same conclusion as the agent, the “explainer” comes to see what the agent saw in her action, thereby satisfying the Reasonableness Constraint. Proceduralism requires giving up on the assumption that the reason for which the agent acts explains the action and on the realist picture of action explanation. In addition, it accounts for the incomprehension that explainers experience when they encounter “alien” psychologies – psychologies that are deeply different from their own. (shrink)

Doctors have an ethical and legal duty to respect patient confidentiality. We consider the basis for this duty, looking particularly at the meaning and value of autonomy in health care. Enabling patients to decide how information about them is disclosed is an important element in autonomy and helps patients engage as active partners in their care.Good quality data is, however, essential for research, education, public health monitoring, and for many other activities essential to provision of health care. We discuss whether (...) it is necessary to choose between individual rights and the wider public interest and conclude that this should only rarely be necessary. The paper makes some recommendations on practical steps which could help ensure that good quality information is available for work which benefits society and the public health, while still enabling patients’ autonomy to be respected. Empedocles' fr. 24 is known only from its quotation by Plutarch. The words as quoted leave themselves open to divergent interpretations. The context in Plutarch nonetheless holds out some hope of being able to decide which of the divergent interpretations would have matched the use that Empedocles himself made of the two verses in his poem.

How was the world generated and how does matter continue to be ordered so that the world can continue functioning? Questions like these have existed as long as humanity has been capable of rational thought. In antiquity, Plato's Timaeus introduced the concept of the Demiurge, or Craftsman-god, to answer them. This lucid and wide-ranging book argues that the concept of the Demiurge was highly influential on the many discussions operating in Middle Platonist, Gnostic, Hermetic and Christian contexts in the first (...) three centuries AD. It explores key metaphysical problems such as the origin of evil, the relationship between matter and the First Principle and the deployment of ever-increasing numbers of secondary deities to insulate the First Principle from the sensible world. In this paper I am going to argue that we should take actions to be prime. This will involve clarifying what it means to claim that actions are prime. I will consider Williamson's construal of actions as prime in a way that parallels his treatment of knowledge. I will argue that we need to be careful about treating our actions in the way suggested because of an internal relation between the success condition of an action and the action itself; a (...) parallel relation does not hold for most cases of knowledge.
